Is your general meeting within the deadlines?

Twenty-one days to serve the notice, one month to notify the minutes, two months to challenge them: enter a single date and the tool lays out the whole calendar, from adding an item to the agenda to the last useful day to act.

The twenty-one days, in detail

This is the deadline most often miscounted, and the one whose error costs the most: it makes the entire meeting voidable.

The clock starts at delivery, not at posting

It runs from the day after the recorded letter is first presented, or from hand delivery. Posting the notice on day minus 21 therefore means missing the deadline.

The sanction: annulment

An owner served late can ask for the meeting to be annulled, resolutions included, within two months of the minutes being notified.

The rule

Meeting date − 21 days = last day for valid service

For a meeting on 15 June, the notice must be presented by 25 May at the latest. Posted on 25 May, it arrives too late: aim for 21 May.

How the notice must be served

The method of service decides when the clock starts — and what proof you will hold.

Recorded delivery with acknowledgement

The default method. The period runs from the day after first presentation, even if the letter is never collected.

Electronic service

Possible with the owner’s express prior consent. The period runs from the day after the message is received.

Hand delivery

Valid against a signature or a receipt. With no signed trace, service will be disputed.

What the condo board checks before the notice goes out

Four points that take ten minutes to verify, and that save a meeting from having to be held again.

    The agenda is complete

    Every item notified in time appears, worded so it can be voted as it stands: a vague resolution cannot be carried out.

    The annexes are attached

    Budget, accounts, quotes, contracts: the documents required for each item travel with the notice, they do not follow later.

    The quotes are there

    For works subject to competitive tendering, the competing quotes must be attached. Without them the resolution is fragile.

    The date fits within six months

    If the meeting approves the accounts, check that it falls within six months of the end of the financial year.

What gets a meeting annulled

A dissenting or absent owner has 2 months after the minutes are notified to act. Here is what they usually rely on.

Late notice

The most common ground, and the easiest to prove: the acknowledgement of receipt carries the date.

Counting from the posting date

Twenty-one days counted from the post office rather than from first presentation: two to four days are missing.

A missing annex

A resolution voted without the document that should have accompanied it can be annulled on its own, without the whole meeting falling.

Minutes never notified

As long as the minutes are not notified, the challenge period does not start: resolutions stay open to attack long after the meeting.
